Peckt is distributed under Apple’s standard Licensed Application End User License Agreement, which applies to the app in addition to these terms. Where the two cover the same ground for an app bought on the App Store, Apple’s agreement governs.
These terms govern your use of the Peckt iPhone application and the peckt.app website, both provided by Oleh Smirnov, an independent developer based in the United Kingdom. By downloading or using Peckt you accept them. If you do not, do not use the app.
Peckt estimates the calorie and macronutrient content of meals from a photograph taken on your iPhone, and lets you log food from a nutrition database. The estimates are approximations produced by a model. They are not measurements.
Peckt is a general wellness and food-logging tool. It is not a medical device and does not diagnose, treat or prevent any condition. Nothing in the app is dietary, medical or clinical advice. Do not rely on it to manage a medical condition, and speak to a qualified professional before changing your diet — particularly if you are pregnant, have an eating disorder, diabetes, an allergy or any other condition affected by food. Calorie budgets are generated from figures you supply and are estimates only.
Peckt shows how confident it is in an estimate and asks you to confirm every drafted number before it is saved. Even so, estimates and database values may be wrong. You are responsible for reviewing what you save and for any decision you make on the basis of it.
Peckt stores your data on your device and, where enabled, in your own iCloud. Because there is no Peckt server, there is no backup held by the developer: if you delete the app and your iCloud data, it is gone. Keeping your device and Apple Account secure is your responsibility. Handling of personal data is described in the Privacy Policy.
Peckt is free to download and includes a free tier. Optional paid features are sold as an auto-renewing subscription through the App Store. Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the end of that period. Manage or cancel a subscription in your Apple Account settings; deleting the app does not cancel it. All billing, refunds and cancellations are handled by Apple under Apple's terms — refunds cannot be issued by the developer. Prices may change; a change will be notified before it takes effect and will never apply to a period already paid for.
Do not reverse-engineer, decompile or modify the app except where that right cannot be excluded by law; do not attempt to extract or redistribute the food database; do not use Peckt unlawfully or in a way that interferes with its operation for anyone else.
The app, its name, mark, interface and content are owned by the developer or its licensors and are licensed to you, not sold, a personal, non-transferable, non-exclusive licence to use Peckt on Apple devices you own or control, in line with the App Store Terms of Service. Nutrition data is derived from USDA FoodData Central (public domain), Open Food Facts (Open Database License) and McCance and Widdowson’s Composition of Foods Integrated Dataset (Open Government Licence v3.0), and portion sizes from Intake24 (Open Government Licence v3.0), AUSNUT 2023 Food measures (CC BY 3.0 AU) and Fineli (CC BY 4.0); the attributions those licences require are shown in the app under Profile → About the data. Your logged data remains yours.
Peckt is provided “as is” and “as available”. To the fullest extent permitted by law, no warranty is given that it will be uninterrupted, error-free, or that estimates will be accurate. Features may be changed or withdrawn. Nothing here excludes rights you have as a consumer that cannot lawfully be excluded.
To the extent permitted by law, the developer is not liable for indirect or consequential loss, loss of data, or any health outcome arising from reliance on estimates. Where liability cannot be excluded, it is limited to the amount you paid for Peckt in the twelve months before the claim. Liability for death or personal injury caused by negligence, or for fraud, is not excluded.
This agreement is between you and the developer, not Apple. Apple is not responsible for the app or its content and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You may stop using Peckt at any time by deleting it. Your licence ends if you materially breach these terms.
Updated terms are published on this page with a new date. Continuing to use Peckt after a change means you accept it.
These terms are governed by the laws of England and Wales, and disputes fall to the courts of England and Wales. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in.
